South Australian Legislation relating to the sale and purchasing of property requires Fasari Property to collect and retain certain personal information.
Throughout the course of its agency agreement Fasari Property may collect personal information from you, including vendors’ and purchasers’ personal details, property information and financial information. We will only request personal information from you when it is required for these purposes.
As a Vendor – your information is collected when we appraise, value or list your property for sale. Information may also be collected during telephone or email correspondence with Fasari Property.
As a Buyer – your information may be collected when you use our website, give your details to one of our sales consultants or make enquires about properties. Information may also be collected during telephone or email correspondence with Fasari Property
Other – we may collect personal information from other parties and publicly available sources, such as from the internet and social media.
Use of and Disclosure of your personal information: we may use or disclose your personal information for the purposes of, or relating to the provision of our services.
Disclosure to Third Parties: we will not provide your personal information to a third party without your express consent, except where it is necessary for the provision of our services.
Examples of third parties to which your information may be disclosed include;
- Form 1 Preparation Companies;
- Internet domains (i.e. realestate.com.au)
- Fasari property employees, professional advisors, suppliers and sub- contractors
Data Retention/Security: we may retain your personal information in either paper or electronic format and will take reasonable precautions to prevent the loss or misuse of your personal information.
We will take reasonable steps to ensure that the personal information we hold is accurate, current, complete, relevant and not misleading and protected from misuse, interference, loss, unauthorised access, modification or disclosure. Please let us know if your details change.
Where personal information is no longer required for any of our functions or activities we take reasonable steps to ensure that the information is securely destroyed or de-identified.
Updating or Accessing Your Personal Information: please contact Fasari Property if you wish to view the personal information we hold about you and/or wish to update your personal information.
We will comply with any request to access your personal information except where the Privacy Act 1988 (Cth) or the APPs allow us to refuse to do so. If we refuse to correct your personal information as requested, we will notify you in writing of the reasons why and how to formally complain about the refusal.
You have the right to ask us to correct information about you that is inaccurate, incomplete, out-of-date, irrelevant or misleading. If requested, we will take such steps as are reasonable in the circumstances so that it will be apparent to users of the information that it is inaccurate, incomplete, out-of-date, irrelevant or misleading.
We may require information from you for us to verify your identity and to specify what information you seek.
Complaints: please contact Fasari property if you have any complaints regarding the collection, use, disclosure or retention of your personal information. We will consider and respond within a reasonable time after receipt of your complaint and will endeavour to resolve it to your satisfaction.
